Waiver
Please read the following terms carefully.
By participating in any class provided at Life Pilates (ABN 88171836671) you consent to, and agree to release the Studio and Instructor from liability according to, these terms. Unless the Instructor notifies you otherwise, this waiver and release will apply to all classes undertaken by you with all Instructors at the studio.
You acknowledge that:
• You understand that the classes are a form of physical activity and that there are inherent risks in undertaking any form of physical exercise;
• You have disclosed, or will disclose to the Instructor prior to the class commencing, any pre-existing conditions that may place you at a higher risk of injury or inhibit your ability to participate in a class, this includes, but is not limited to:
- Injuries, pain or recent surgery;
- Pregnancy or if you have recently given birth; or
- Respiratory or heart conditions or high blood pressure.
• You will notify the Instructor if you experience any pain throughout the class and will immediately stop participating in the class if requested by the Instructor to do so;
• Based on information you provide, the Instructor may decide not to allow you to participate in a class, or may require you to provide a medical certificate affirming that you are able to participate in a class before allowing you to join, in the Instructor’s sole discretion;
• Recommendations or instruction provided by the Instructor may not be tailored for your particular skill or ability level and it is your responsibility to assess whether you are able or want to participate in all or part of a class;
• You are solely responsible for ensuring that your physical environment is suitable for your participation in any class; and
•Classes may be recorded for by the Instructor for quality control, as well as promotional purposes. If you do not consent to the Instructor using video or still images taken during the class for promotional purposes, please notify the Instructor in writing.
To the extent permitted at law, you release and hold the Instructor (and where applicable its, directors, employees and representatives) harmless from any liability, cost, expense, damages or claims (including claims of negligence) arising from or which may be suffered or incurred in connection with your attendance at the studio or participation in any classes provided by the Instructor at the studio.
I agree that Life Pilates is in no way responsible for the safekeeping of my personal belongings while I attend class. I understand that classes may be physically strenuous and I voluntarily participate in them with full knowledge that there is risk of personal injury, property loss or death. I agree that neither I, my heirs, assigns or legal representatives will sue or make any other claims of any kind whatsoever against Life Pilates or its members for any personal injury, property damage/loss, or wrongful death, whether caused by negligence or otherwise.
Life Pilates does not assume responsibility for any lost or stolen personal property. If you do become the victim of a theft, immediately report it to a Life
Pilates staff member.
By booking into and confirming a class you automatically agree to the above Release and Wavier as well as Terms and Conditions outlined below.
Cancellation Policy
If you have booked into a class and need to cancel, please withdraw from the class through the Online Booking System. In order to cancel your attendance without penalty, please remove yourself from the class by using our Online Booking System. Unfortunately, we cannot accept cancellations by phone, text or social media. Our instructors often have back to back classes or clients and cant address the cancellation.
If you do need to cancel a class, the following cancellation fee structure will apply:
• Early cancel: If you can no longer make it to your class and you cancel your booking a minimum of 12 hours before the scheduled start time, you won’t forfeit the class from your pack.
• Late cancel or no-show: If you cancel within 12 hours of the class start time, unfortunately you will forfeit the class from your pack or membership as it often means that another client misses out.
From time to time we may need to substitute your normal instructor or cancel a class if deemed necessary (for example: due to an instructor being unable to attend). In the event we have to cancel the class we will notify you via the app and you will not lose any classes you have paid for.
Waitlist Policy
If the class you’d like to attend is fully booked, we recommend joining the waitlist. There are often changes to class attendance and places regularly become available. Should a place open up for you, you will receive a notification via email or text message. We kindly ask that you respond to this admin@lifepilates.com.au notification, either accepting or declining your place.
We totally understand if you can no longer attend, but please notify us as quickly as possible so that your place can be offered to the next member on the waitlist.
Booking a Class
To attend your preferred classes, please book using our ‘Online Booking System’. This includes booking via the website or app. This helps us to ensure there is enough space available for each class. Classes can be booked up to 6 months in advance via our Online Booking System.
To book into a class you should either have an active membership, a class pack with the equivalent amount of classes available or alternatively you can make a payment at the time of booking.
Pricing
All prices quoted/contracted for goods and services include GST, unless otherwise specified. Life Pilates may, from time to time at its absolute discretion, vary its prices based on, amongst other things, any change in the cost of providing these goods and services to you, without prior notice.
Class Start and End Time
We aim for all our classes to start and end on time, so we recommend arriving at the studio no more than 5 minutes before the start of class. This will allow the class before to leave and the studio be reset for your class.
Privacy Policy
Life Pilates is committed to providing quality services to you and this policy outlines our ongoing obligations to you in respect of how we manage your Personal Information.
We have adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (the Privacy Act). The NPPs govern the way in which we collect, use, disclose, store, secure and dispose of your Personal Information.

What is Personal Information and why do we collect it?
Personal Information is information or an opinion that identifies an individual. Examples of Personal Information we collect include: names, addresses, email addresses, phone and facsimile numbers.
This Personal Information is obtained in many ways including interviews, correspondence, by telephone and facsimile, by email, via our website, from media and publications, from other publicly available sources and from third parties. We don’t guarantee website links or policy of authorised third parties.
We collect your Personal Information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your Personal Information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.
When we collect Personal Information we will, where appropriate and where possible, explain to you why we are collecting the information and how we plan to use it.
Sensitive Information
Sensitive information is defined in the Privacy Act to include information or opinion about such things as an individual's racial or ethnic origin, political opinions, membership of a political association, religious or philosophical beliefs, membership of a trade union or other professional body, criminal record or health information.
Sensitive information will be used by us only:
• For the primary purpose for which it was obtained
• For a secondary purpose that is directly related to the primary purpose • With your consent; or where required or authorised by law.
Third Parties
Where reasonable and practicable to do so, we will collect your Personal Information only from you. However, in some circumstances we may be provided with information by third parties. In such a case we will take reasonable steps to ensure that you are made aware of the information provided to us by the third party.
Disclosure of Personal Information
Your Personal Information may be disclosed in a number of circumstances including the following:
• Third parties where you consent to the use or disclosure; and
• Where required or authorised by law.
Security of Personal Information
Your Personal Information is stored in a manner that reasonably protects it from misuse and loss and from unauthorised access, modification or disclosure.
When your Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client files which will be kept by us for a minimum of 7 years.
Access to your Personal Information
You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.
Life Pilates will not charge any fee for your access request, but may charge an administrative fee for providing a copy of your Personal Information.
In order to protect your Personal Information we may require identification from you before releasing the requested information.
Maintaining the Quality of your Personal Information
It is important to us that your Personal Information is up to date. We will take reasonable steps to make sure that your Personal Information is accurate, complete and up-to-date. If you find that the information we have is not up to date or is inaccurate, please advise us as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.
